Terms of Service

These Terms of Service ("Terms") govern your access to and use of FocusKitty. By accessing or using FocusKitty, you agree to be bound by these Terms. If you disagree, please do not use the service.

1. Description of Service

FocusKitty is a Pomodoro-based focus timer application available in two tiers:

• Free tier: Full access to the timer, all view modes, all themes, and basic session tracking via browser storage. No account required.
• FocusKitty Plus (coming soon): Premium features including detailed stats, focus streaks, ambient soundscapes, unlimited session history, and more. Requires an account and a paid subscription.

2. Accounts

Creating an account is optional for basic use of FocusKitty. An account is required to access premium features and to sync your session history across devices.

You may create an account using your email address and a password, or by signing in with your Google account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must provide accurate and complete information when creating an account. You may not impersonate others or create accounts for deceptive purposes. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorised access to any part of the service or its related systems
• Reverse engineer, decompile, or attempt to extract the source code of the application
• Interfere with or disrupt the integrity or performance of the service
• Use automated tools or bots to scrape or abuse the service
• Resell or sublicense access to the service without our written permission
• Upload or transmit any harmful, offensive, or malicious content

4. Payments and Subscriptions

FocusKitty Plus will be available as a monthly subscription when launched. Pricing is displayed at the time of purchase and may vary by region (INR for India, USD for other regions). All prices are inclusive of applicable taxes where required.

Payments are processed securely through Stripe (international) or Razorpay (India). We do not store your payment card details. Subscriptions renew automatically unless cancelled before the renewal date.

Refunds: We offer a 7-day refund policy for FocusKitty Plus subscriptions. If you are unsatisfied within the first 7 days of your paid subscription (after any free trial), contact us at for a full refund. After 7 days, refunds are at our discretion. hello@focuskitty.app.

5. Intellectual Property

FocusKitty and all its content, features, design, and functionality — including but not limited to the logo, visual design, code, and written content — are owned by us and protected by applicable intellectual property laws.

You retain ownership of any data you create through using the service, such as your focus session records. You grant us a limited licence to store and process this data solely to provide the service to you.

6. Data and Privacy

Your use of FocusKitty is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

7. Availability and Modifications

We strive to keep FocusKitty available at all times but do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue any part of the service at any time. We will provide reasonable notice of significant changes where possible. For paid subscribers, if we discontinue a paid feature, we will offer a prorated refund for the remaining subscription period.

8. Disclaimer of Warranties

FocusKitty is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that the service will be error-free, uninterrupted, secure, or free of viruses. Your use of the service is at your own risk.

9. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service, including but not limited to loss of data, loss of productivity, or loss of revenue. Our total liability to you for any claims arising from these Terms or the service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

You may stop using FocusKitty and delete your account at any time. We may suspend or terminate your access if you violate these Terms, or for any other reason at our discretion with reasonable notice. Upon termination, your right to use the service ceases and we may delete your account data in accordance with our Privacy Policy.

11. Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts located in India.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by email or by posting a notice in the app. Continued use of FocusKitty after changes take effect constitutes your acceptance of the revised Terms.
